A California man accused of taking government documents, he said, was from Mitch McConnell’s office and attempting to steal an American flag from Capitol Hill has been charged in connection with the deadly riot that took place in Beginning of the month.

Tommy Frederick Allan was arrested for violently entering or disorderly conduct on Capitol grounds, entering a building or restricted land and damaging or stealing federal property, according to a criminal complaint filed Jan. 20 in federal court in Washington, DC

An arrest warrant describes how two people sent information to the FBI alleging that Allan was part of the Jan.6 attack on the U.S. Capitol. Authorities said the riot resulted in the deaths of five people, including a Capitol Hill policeman.

The first informant sent photos and videos from Allan’s Facebook page that show the suspect inside and outside the Capitol, according to the arrest warrant.

The second person said she was also aware of the photos and videos, but reported that Allan had deleted his Facebook page. This same informant said that Allan destroyed the documents he took from the Capitol when he returned home in Rocklin, California.

Upon further investigation, the FBI discovered that Allan had flown from Sacramento to Washington, DC on January 5 and returned to California on January 7.

Videos of the Capitol riot taken by reporters and a security camera show Allan, with an American flag in one hand, taking a document from a desk in the Senate Chamber and hiding it in his back pocket, according to the warrant stop. A law enforcement officer prevented Allan from leaving with the flag, but he came out with the papers, videos show, according to the arrest warrant.

Another video, posted on someone else’s Facebook page, shows Allan holding the documents outside the Capitol, authorities said in the warrant. One of the documents read: “United States Senate, Hundred and Seventeenth Congress, Schedule of Business, Wednesday January 6, 2021”.

Allan tells the person recording the video that one of the papers was “a letter from Trump” and was “signed by Trump,” and a signature resembling Trump’s is visible on the paper, according to the FBI. He can also be heard that he withdrew documents from the office of Senate Majority Leader Mitch McConnell.

When someone off camera asks him why he took the documents, he says he’s a “taxpayer,” according to the warrant.

A public defender assigned to Allan said she and her client had no comment.

Allan appeared in court after his arrest on Jan. 22 and was released, Federal Court documents show. He is due back in court on Friday.
