California Democratic Governor Gavin Newsom could have his emergency powers removed

California Democratic Governor Gavin Newsom could have his emergency powers revoked after a Republican lawmaker on Wednesday released a bill demanding changes to the governor’s emergency authority as the coronavirus pandemic continues to ‘increase.

The bill, introduced by assembled Jordan Cunningham, calls for the immediate limitation of the governor’s ability to enact or amend laws under the California Emergency Services Act (CESA) to 60 days after an order d emergency was called.

Cunningham’s bill follows California’s nearly 290 days under a “state of emergency” amid the coronavirus pandemic and the latest round of state-enforced shutdowns, as cases spike in the Golden State.

“For 287 days, [Newsom] has unilaterally changed laws and regulations without any input from the Legislature, “Cunningham said on Twitter.” It’s time to restore California to a constitutional democracy and ensure that a governor has no more unilateral undefined power.

The changes would require the governor to seek approval from California lawmakers before making any changes to the law or regulations.

Neither Cunningham nor Newsom could be reached immediately for comment on the bill.

California has seen coronavirus cases increase dramatically in recent weeks, far exceeding their highest daily case load since the first peak in the spring.

More than 52,000 new cases were confirmed as of Thursday, contributing to the state’s more than 1.7 million cases of coronavirus. An additional 379 new deaths have been reported by the state’s Department of Public Health, pushing California closer to 22,000 COVID-related deaths this year.

Newsom ran into a problem last month when a northern California judge ruled that the governor had overstepped his authority in one of dozens of executive orders issued during the state’s pandemic, and found “an exercise unconstitutional legislative power, “KTVU reported.

Sutter County Superior Court Judge Sarah Heckman felt that an order issued by Newsom in June was beyond his authority when he called for the creation of hundreds of polling stations across the state and the has prevented the issuance of orders under the CESA that “amends, modifies or amends existing statutory law or makes new statutory law or new legislative policy.”
