Capitol rioter seen smoking in Rotunda arrested

The FBI said On Tuesday, he arrested a man who was allegedly seen smoking in the Capitol rotunda during the deadly January 6 riot.

According to an FBI complaint, a witness submitted videos of Greg Rubenacker, a man from New York, apparently smoking in the rotunda during the breach of the Capitol. Officials said the videos were posted to Snapchat by Rubenacker.

In a clip, Rubenacker reportedly said, “Holy shit! This is history! We took the Capitol! In another segment, he reportedly said, “Smoke the Capitol, baby.” According to the complaint, Rubenacker appeared to smoke a marijuana cigarette and use a vaping device.

A Snapchat story appearing to be from Rubenacker’s account showed protesters outside the Capitol with the caption “America is pissed off.”

“The witness said [they] had known Rubenacker for several years and had attended school with Rubenacker, ”states the FBI complaint. When shown the photo of the driver’s license, the witness said the photograph depicted the same Greg Rubenacker [they] knew and had observed in Snapchat history. “

Rubenacker appeared in U.S. District Court in Central Islip, New York on Tuesday via video conference, according to CNBC. It faces multiple charges related to disorderly conduct inside the Capitol.

“It’s really frustrating,” Rubenacker reportedly said. “Tired of corruption in government.”

According to CNBC, his lawyer replied, “Now is not the time to talk about the case.”

Rubenacker’s case was filed in federal court in Washington, the outlet noted, as have all cases against people accused in connection with the violent riot.
