Captain America actress “is not qualified to stand trial for her mother’s murder”

CAPTAIN America actress Mollie Fitzgerald has been declared unfit to stand trial for the murder of her mother, her lawyer has said.

The 38-year-old is charged after Patricia “Tee” Fitzgerald, 68, was found dead in a house on December 20, 2019.

According to TMZ, the former actress was due to appear in court in late September where she would face second degree murder charges.

But, speaking to the outlet, attorney Jason Billam, who represents her, confirmed that three mental health doctors said she was unfit to stand trial and the court was satisfied with their conclusions.

He says the majority concluded that Mollie did not have the capacity to help her lawyer provide a defense because she was “confused” about the legal process.

She has since been returned to a public psychiatric hospital where she will continue her treatment, the lawyer added.

The news comes about 21 months after the arrest of the 38-year-old man was made public on January 1, 2020.

A day later, The Sun got the exclusive audio from a police dispatcher where she allegedly admitted her guilt via a spooky call to 911 on the night of her mother’s death.

In the audio, an operator reported an “armed disturbance”.

The operator continues: “Case with a knife. Perp now says she took the knife and killed her mother with it.

According to the offense report from the Olathe Police Department, the incident was reported at 11:58 a.m. before authorities found Patricia, 68, dead in the house.

A knife was listed in the report as the weapon of the fatal stabbing.

Police at the time confirmed that: “A 38-year-old white woman known to the victim was contacted at the scene and taken to a local hospital with minor injuries.”

She was charged later that night and has since been held on $ 500,000 bail.

DESCENDING SPIRAL

Meanwhile, Mollie’s friend, who wished to remain anonymous, said the struggling actress had gone from “gentle” to “paranoid” in the years leading up to the fatal stabbing.

The friend said she noticed a change in Mollie, 38, when she started posting bizarre statuses online.

The pal said: “A few years ago I noticed the weird messages online about electromagnetic abuse, which is what I think it was, and government spying.

“It was very paranoid and weird, so I felt something really was wrong.”

The friend continued that Mollie also brought “paranoid” and “crazy” charges against her own parents.

The confidante added: “I felt she was going off the rails and was going to do something crazy. Never murder though.

Despite the downward spiral, the friend remembers Mollie as a “fun, sweet and amazing person”.

Mollie had already made her way into the film industry after playing a “Stark Girl” in the 2011 movie Captain America: The First Avenger.

She also starred in The Lawful Truth in 2014 and Trouble Is My Business in 2018.
