Prosecutors wrote in the court document that each homicide was “particularly heinous, atrocious or cruel, manifesting exceptional depravity.”
An Idaho grand jury indicted Daybell and Vallow in May with murder in connection with the deaths of Vallow’s two children, Tylee Ryan, 17, and Joshua “JJ” Vallow, 7.
Daybell is also charged with the murder of his then-wife Tammy, who was originally believed to have died in her sleep in October 2019, less than three weeks before Daybell married Vallow.
The children’s disappearance became national news after Daybell and Vallow abruptly left Idaho following police questioning about Tylee and JJ’s disappearance as well as the death of Tammy Daybell.
The Vallow children were last seen on separate days in September 2019. Law enforcement found their remains on rural Daybell property in Fremont County nine months later.
Along with the murder charges, Daybell is charged with insurance fraud arising from life insurance policies that allegedly paid him money after his wife died.
Vallow is accused of grand theft for allegedly continuing to receive social security benefits for her children after their death.
Vallow’s case was suspended indefinitely after a judge determined she was not currently competent to stand trial and recommended that she undergo psychological treatment, according to a court order.
