Regional judge Rogerio Favreto of the Fourth Region (TRF-4), based in Porto Alegre, granted a "habeas corpus" requested by Labor Party (PT) deputies, arguing the absence of legal grounds for his imprisonment.

The magistrate ordered the suspension of the provisional execution of the sentence and the release of Lula under an "emergency" regime, so that the exmandatario could be published that same Sunday.

In his ruling, The Judge also argues that the prison of the former president prevented him from exercising his rights of pre-candidate for the presidency of the Republic, even though he was practically disqualified after the conviction in the second instance .

Lula has been detained since last month. April at the headquarters of the Federal Police Curitiba, after being sentenced in second instance to 12 years and one month in prison.

The exmandatario had already been sentenced last July by trial judge Sergio Moro, in charge of the first instance investigations in the Petrobras case, 9 years and 6 months in prison for the crimes of pbadive bribery and money laundering.

The sentence was raised to 12 years and 1 month by an appellate court.
