Gustavo Petro's lawyer, Dagoberto Quiroga, alleged Thursday that his client was not obliged to pay the fine imposed by the Superintendence of Industry and Commerce (SIC ) for 419 million since 2014 for his alleged responsibility in the apparent management irregularity of garbage problem in Bogota, when he was mayor of that city.

The statement came after the CLC ordered the Senate Secretariat to seize one-fifth of the salary that Petro will receive as a senator, to pay the fine

However, the defender of the Senate former presidential candidate said that since the sanction has been continued in the courts of administrative litigation, "the embargo is invalid".

"Until there is a decision of administrative litigation, this collection can not be executed," said Quiroga

Petro himself pronounced and said stated that "the decision of the Superintendence against me is illegal".

The Superintendency, for its part, considers that the fact that the former mayor challenged the fine "does not remove the presumption of legality" from the sanction, for which it considers it definitive and must to be recovered.

For three years, Petro refused to pay the fine that already amounted to $ 580 million and the General Secretariat of the Senate is now obliged to deal with the reduction of July 20, when the former candidate will take possession of the seat.

Another sanction that Petro had received from the District Comptroller was alleged property damage caused by the lowering of the TransMilenio ticket price.
As Quiroga explained, this sanction was suspended by the Administrative Court of Cundinamarca, because "due process was violated". This case is still before the court because no decision on the merits has been rendered.

In this way, despite two lawsuits against him, Petro will have no problem becoming a senator.
