Elon Musk teases the "Teslaquila" update while the fate of the brand is uncertain

Tesla CEO Elon Musk once again mocked the imminent arrival of the brand of agave liquor, the manufacturer of 100% electric cars, Tesavequila. On Friday night, a commentary and response session on Twitter by the business mogul resulted in a status update request regarding the spirits brand, to which Musk responded, "Coming soon!

Teslaquila's original story involves an April Fools' joke from last year in which a photo of Musk asleep against a model 3 was posted on his Twitter account, apparently a hangover after Tesla's statement of "all chapters" of bankruptcy, including the fictitious chapter "Chapter 14 and a half (the worst). A bottle proposal from Teslaquila was later posted on his Instagram account (now deleted), demonstrating that the CEO was serious about producing the drink, including 750ml containers containing 40% alcohol.

A US trademark application for Teslaquila was filed in October; however, in January of this year, the trade-mark office rejected the mark, citing another brand of alcohol deemed confusingly similar to Teslaquila: Spirit Tesla. The trademark Spirit Tesla belongs to the Serbian Valjevsko brewery and the alcoholic beverages sold under this brand include a photo of Nikola Tesla.

At first, the similarities between the two names – Teslaquila vs. Spirit Tesla – may not seem significant given the ubiquitous nature of the Tesla car brand and the well-known and amusing antics of its CEO. But the role of the US Patent and Trademark Office is to protect consumers from confusion. Thus, two brands of spirits bearing names inspired by the famous inventor could mislead a buyer into believing that the same company was selling both products. Tesla's trademark attorneys will probably file an answer in which they will challenge the rejection of their claim. They have until the end of July to take such a step.

At the time of Teslaquila's tweet of April 1, Tesla had just released its production and deliveries report for the first quarter of 2018, which reported a 40% increase in production compared to the fourth quarter of 2017. This number included a four-fold increase in the model 3 production rate. This led to a record 2,020 model 3 cars manufactured in 7 days. Tesla's actions rebounded in response and Musk's humor seemed to be a nod to critics of the company.

There are only a few days left before Teslaquila's first birthday, so Musk may have planned something for his "bad news" drink, hence the tease "coming soon". A celebration of Tesla's anticipated release of the standard Model 3 and Model Y display, worth $ 35,000, would certainly be a call for festive sparkling shots of the spirits brand. Until then, fans of musk and its companies are waiting.
