Of course, Musk is no stranger to controversy on Twitter. On Monday, the regulator asked a judge to despise Musk for a tweet about the Silicon Valley automaker's production targets. Musk has until March 11 to tell the court why it should not be considered a contempt.

The deal was made public by Musk's tweets becoming private to use last year, when Musk said he had "secured funding" to take Tesla for private purposes. As part of the agreement, Musk and Tesla agreed to oversee the CEO's tweets that may contain important information for Tesla's shareholders.

Tesla shares lost 11% in the last 12 months, in contrast to gains of about 1.4% for the S & P 500 Index.
