The Chicago attorney and longtime attorney, Mark Rotert, was hired by Foxx 22 months ago to redevelop the state's attorney's office to investigate wrongful conviction complaints.

Rotert announced that he was leaving the state prosecutor's office on March 27, the day after the fall of the hate crime charges against Foxx against the Empire's Jussie Smollett actor . The timing of Rotert's departure fueled speculation that he was linked to the Smollett controversy that began with Foxx's challenge.
In our interview, Rotert says the timing, though regrettable for him and for Foxx, was a coincidence and that he had decided to leave the office a few months earlier.
Rotert, a former US deputy prosecutor, former associate of the Illinois Attorney General 's Office and a long – time member of the defense bar, spoke to the state of mind of the office during the debacle of Smollett said that such controversies are sure to occur second largest prosecutor's office in the nation.
He did not deplore Foxx, his decisions or his performance and did not mean directly he thought that she had acted correctly at Smollett.
However, Rotert talked a lot about the conviction unit for the integrity that he revised during his under two years and said that the unit's work was continuing then even that he was surrounded by fiery controversy and that he was calling for the resignation of Kim Foxx. He spoke openly about the difficulties of dealing with the police, other prosecutors and defense lawyers regarding the investigators' misconduct, poorly structured cases and exemptions from scientific evidence.
Rotert's resignation coincided with that of April Perry, another state prosecutor under Kim Foxx. This dual departure further exacerbated public relations at the state attorney's office last month. Perry was the Ethics Officer and had announced the disqualification of Ms. Foxx in the Smollett case. She has not spoken publicly about her resignation or mandate.
