The family of an 11-year-old child who died in Texas is suing the utility company Entergy and the operator of the Electric Reliability Council of Texas (ERCOT) for more than $ 100 million, alleging gross negligence as a result of the death of the boy. Cristian Pavon died Tuesday after a frosty night at his family’s mobile home in Conroe, Texas.
The house had been without electricity since the previous Sunday.
As reported by KHOU, a CBS Houston affiliate, the lawsuit claims Pavon died of hypothermia. A cause of death has not yet been revealed by forensic scientists.
The family is represented by lawyer Tony Buzbee. CBS News has asked for comment.
Pavon’s mother, Maria Elisa Pineda Guzman, said the family slept in a room to warm up. “He fell asleep. He was wearing a shirt, a sweater, two pants, socks,” Pavon’s aunt, Jaliza Yera, told K’HOU. His stepfather checked him out later that evening and put on another blanket.
The family attempted to wake Pavon up on Tuesday afternoon but he did not respond. The family told KHOU that they had tried to call 911 but were waiting for a Spanish speaking operator.
KHOU obtained statements from Entergy and ERCOT about the case. “We are deeply saddened by the loss of life in our community. We cannot comment due to an ongoing litigation,” Entergy replied.
ERCOT issued a statement saying it has yet to consider the lawsuit. “[We] will respond accordingly when we do. Our hearts go out to all Texans who have suffered or are suffering because of the past week. “
“However, given that around 46% of private generators went offline on Monday morning, we are confident our grid operators made the right choice to avoid a statewide blackout,” said ERCOT.
