Former Texans public relations manager Amy Palcic hires Houston lawyer

By abruptly firing their public relations manager, the Texans had a major public relations problem. The Texans have also acquired a potential legal problem.

Via Ben Fischer from Sports Business Daily, Amy Palcic hired Houston attorney Joseph Ahmad.

“The only thing I can say is that I was held up by Amy, and other than that, at the moment I really have nothing to say,” Ahmad told Fischer.

That pretty much says it all. Laid-off employees typically hire lawyers to assess the facts in light of applicable law to identify potential causes of action. A negotiated settlement agreement is also possible, the threat of litigation providing leverage.

Palcic was reportedly informed that she was no longer “culturally appropriate”, which could be a pretext for one or more motivations protected by state or federal law. She may also have a contract that may have been broken and she may have engaged in a protected activity such as raising concerns raised by specific employment policies, practices or comments at the workplace by management.

Whatever the legal theory, if Ahmad identifies one, the case may ultimately be whether and to what extent he can poke holes in the explanation of “cultural fit.” According to the argument, if the reason stated by the employer can be shown to be false or illogical, it is possible that the stated reason was covered for a reason that violates the law.
