In April, five men including a member of the Spanish Guardia Civil were sentenced to nine years in prison for " badual abuse " and " abuse of weakness " committed on a young girl of 18 years during the Pamplona festivities in July 2016.

" It is because the city of Pamplona exercised a lawsuit that the trial took place ," says Marie Pérès , although she deplores " a ridiculous condemnation " which also caused a wave of demonstrations in Spain.

In France, Article 2 of the Code of Criminal Procedure states that " the civil action belongs to all those who have personally suffered the damage directly caused by the offense ".

" The law also provides that in some cases, the defense badociations may be civil parties.For a town hall it will be more difficult ," said the prosecutor.

But for Ms. Bisauta, the mayor UDI of Bayonne, Jean-Rene Etchegaray, " lawyer of his state, considered the question and according to him, that poses no problem ".

According to Mr. Vuelta Simon, a dozen cases of badual badault or rape go back to the floor each year after the Bayonne Festivals, often on the background of extreme alcoholism. Only two or three files lead to prosecution, usually because of the lack of precise facts.

" But many situations are killed by fear or ignorance ," the prosecutor complains.

" Let me not be told that these criminal acts are inherent in the number of people participating in these festivals (more than a million visitors last year, Ed.) I am convinced that this also occurs in small village festivals in France, it does not say ", adds Martine Bisauta.
