Trump’s lawsuit, filed on New Years Eve, marked his latest attempt to overturn results in a key state won by President-elect Joe BIden. But the state’s first filing of the case comes amid an explosive scandal over Trump’s attempt to privately pressure Raffensperger to accept his fraud claims and ‘find’ thousands more votes to reverse the result.
The legal brief was also filed just as Trump took the stage in Georgia on the eve of the Senate second round that will determine control of the US Senate. Trump wasted little time before attacking Kemp and Raffensperger at the rally to revive the Senate campaigns of David Perdue and Senator Kelly Loeffler to further attack the presidential election results.
“I’m going to be here in a year and a half,” Trump said, “and I’m going to campaign against your mad governor and secretary of state.”
Trump has baselessly alleged widespread fraud and misconduct by election officials, accusations he repeatedly reiterated during his hour-long call on Saturday with Raffensperger, despite the secretary’s strong crackdown and rejection of his assertions. Since the tape of their Extraordinary Appeal was released in the Washington Post and Atlanta Journal-Constitution on Sunday, Raffensperger has also conducted television interviews in which he defended his handling of the Nov. 3 electoral process. Monday night’s brief reinforced his arguments.
“The people, the secretary and the governor have all respected and honored their obligations under Georgia and federal law – as have the … duly certified presidential voters,” the state brief reads.
Trump and his supporters having filed around 60 lawsuits in various states, winning virtually no relief, the re-submission by Georgian officials contains few free-form legal arguments. Instead, after forcefully dismissing Trump’s claims, the brief chains quotes from the myriad of court decisions – many written by Trump appointees – dismissing previous challenges.
U.S. District Court Judge Mark Cohen has set a hearing for Tuesday morning on the Trump campaign trial and the emergency call for help. However, the judge criticized the president’s lawyers for not getting the case started faster.
“Although the plaintiffs’ attorney could have requested … an immediate hearing over this past holiday weekend, and obtained a hearing before the district judge on duty, the attorney did not.” Cohen wrote, noting that Trump wanted to appeal the case. to the Supreme Court if necessary by Wednesday, the day Congress is due to meet to count the electoral votes.
