As he hardly speaks German, the son of a Roma couple is considered by the Bavarian authorities as mentally handicapped – and must now attend a special school. Later, it turns out that he is completely healthy. Nevertheless, he is not allowed to attend a normal school.

A young man who has been unjustly sent to a specialized mental health school is entitled to compensation. The state of North Rhine-Westphalia has violated its duties and must now adhere to it, decided the Cologne District Court. The amount of compensation has not yet been decided. The former high school student had claimed about 40,000 euros in damages for loss of profits.

The 21-year-old was clbadified as mentally disabled in Bavaria in 2004 and sent to a special school. He hardly spoke German when he was enrolled, his parents are Roma. After moving to Cologne, he repeatedly asked unsuccessfully for a change of school – but without success. Until the age of 18, he still had to attend a special school.

According to the district court, the Cologne School should have noticed during an annual review that the student no longer needed support in the field of intellectual development. In that case, he could have graduated earlier. The verdict is not yet final.

Later, the young man, among the best in his clbad, graduated from a high school graduate of a professional college. According to the parents' badociation "in the heat of the moment", which is committed to inclusion and supported the 21-year-olds, he now works in a supermarket and is looking for training as a trader.
