The company does not want to exclude comparisons with Klgern in principle. "We will defend ourselves with all means in this legal complex, and with determination," said Bayer's managing director, Werner Baumann, in St. Louis, Missouri. He again referred to "more than 800 scientific studies" proving that the glyphosate weed killer was safe.

It would be conceivable to agree in very specific cases if the costs of preparing and defending the process of the next few months would be higher than those of a comparison. However, this would be a purely economic decision, according to Baumann. Basically, Bayer wants to defend himself vigorously.

Digger Johnson, the first glyphosate runner, brings back his lymphatic cancer to his weed killer treatment while he was working as a camp supervisor in California schools. A jury awarded Johnson $ 289 million (255 million euros) in August. As a result of the jury's verdict, Bayer's shares lost up to 30% of their value. Currently, they cost about a quarter less than at that time. This corresponds to the value Brsen minus 20 billion euros.

Bayer and Monsanto challenged the verdict. However, the competent judge, Suzanne Ramos Bolanos, has reduced the amount of the fine to about $ 78 million. Bayer now wants to appeal and build on a now-modified legal strategy.

Unlike the Johnson case, which was tried by a state court, the vast majority of newcomers were referred to about 8,700 cases in federal courts. Because of their large numbers, they have been grouped into a multi-district process. At the same time, individual federal courts entrust the case to a centrally determined court. The cases are then prepared and the documents and statements of the experts and witnesses are recorded.

According to legal expert Matthew Thurlow, it is currently important to select precedents that reflect a representative sample of all complaints. He said in early October at a conference hosted by the Bernstein Research house on glyphosate. These cases would then be negotiated in February and could help the parties better understand the magnitude of the potential charges and finally agree.
