Feldkirchen-Westerham: residents triumph over the road lighting process

The Bavarian community of Feldkirchen-Westerham, near Rosenheim, has to replace or darken two street lamps because they prevent residents from sleeping.

The Munich Administrative Court has followed the evaluation of an expert opinion, which badumes a "considerable deficiency". This forced the community to adhere to a few limits for the psychological burden.

The community lawyer announced that she wanted to appeal. A married couple, who could not rest easy because of the light, sued. The two lanterns in front of her house were renewed in 2013. Since then, the room has been so bright that "we only sleep ten nights, which was a problem before," said plaintiff Robert Rypacek before the trial.

He and his wife Elvira have been trying for years to defend against bright LED bulbs horizontally and, according to their own information, they did not want to go to court. But with the community and the mayor, no agreement was possible, Rypacek said. Even when the couple offered to pay for the conversion itself, the community rejected it.

Their lawyer said that every day, someone came to the town hall and wanted something else. In addition, a precedent should be avoided. The municipality is also right because it complies with DIN standards.
