Bayer has asked a US judge to overturn the verdict rendered by a billionaire of a Californian jury against the pharmaceutical and agrochemical group Leverkusen as part of the lawsuit against glyphosate. The verdict of the jury was not substantiated by the facts, said Monday in Oakland court a communication. Instead, the judgment goes back to "seditious, fabricated and irrelevant evidence" of plaintiffs' lawyers. The case was an "abstract smear of Monsanto". Justice Winifred Smith should either quash the verdict or order a new trial.
The jury ordered Bayer to pay over $ 2 billion in damages to the cancer couple Alva and Alberta Pilliod. This is responsible for several decades of using Roundup's herbicide containing glyphosate from Bayer's subsidiary Monsanto for its disease. Bayer rejected that.
For the company, it was by far the most severe judgment in the context of the weed killer. Previously, a jury, last August, had allocated $ 289 million to a man also suffering from cancer. However, a judge reduced this amount to $ 78 million. In another lawsuit, Bayer was sentenced to pay more than $ 80 million in damages. In the United States, there are currently about 13,400 complainants for glyphosate.
In mid-June, the chemicals company announced over the next ten years about five billion euros for the development of glyphosate alternatives. At the same time, however, the company pointed out that glyphosate "will also continue to play an important role in Bayer's agriculture and product range". According to the group, the corresponding products are safe if used correctly.
