Compensation for flight delays: The airline must pay according to the court's decision

This was decided by the European Court of Justice in Luxembourg on Wednesday (Case C-523/17). Financial responsibility in case of cancellation or long delay brings the company that starts a flight, the judges said.

In this case, Tui-Fly is now obliged: The airline had rented the aircraft and the crew of Thomson Airways, on the air ticket was "executed by Thomson Airways ". The Hamburg Regional Court wanted to know from the ECJ which airline is considered an "executive air carrier" within the meaning of the EU rules and therefore has to pay compensation.

If a flight is canceled or delayed by more than three hours, pbadengers are entitled to compensation under EU law.
