Federal Administrative Court: Landesbank Berlin must hold NPD accounts

The Berliner Landesbank must establish accounts for the anti-constitutional NDP against its will. This was decided by the Federal Administrative Court as part of a review procedure. The NDP is entitled to equal treatment, said 6th Senate Speaker Ingo Kraft at the decision. This claim also exists, although the party pursues unconstitutional objectives.

Judgments of the lower courts confirmed

Thus, the Federal Administrative Court upheld the judgments of the lower courts. More than five years ago, the district badociations of NPD Charlottenburg-Wilmersdorf and Tempelhof-Schöneberg in Berlin wanted to open a current account with the Berliner Landesbank. However, she rejected the applications because she had considerable doubts about the formation of badociations. The Landesbank was not entitled to such thorough revisions of the merits and rights of the parties, the Leipzig judges explained their decision.

The Oberverwaltungsgericht Berlin-Brandenburg (OVG) had declared in its judgment of October 2016 that the application for opening an account was the result of the law on parties. After all, the two district badociations did not belong to a banned party and Landesbank Berlin also held current accounts for district badociations of other parties. Because of its fundamental importance, the OVG had approved the appeal before the Federal Administrative Court.
