FrankfortThe sports car manufacturer Porsche does not want to accept the first judgment concerning the withdrawal of a diesel vehicle. The Stuttgart Regional Court was the first court to grant a customer complaint against Porsche AG. The company confirmed Monday a preliminary report on the "Frankfurter Allgemeine Zeitung" (Tuesday edition). However, the judgment is legally flawed. Porsche therefore badumes that the decision of the court of appeal of the Higher Regional Court will be corrected.

According to the newspaper, the automaker took over a customer of Porsche Cayenne, four years old, against nearly 60,000 euros, plus interest. In the car, an unacceptable defeat device was installed, which was immoral, said the Stuttgart District Court. Porsche has deliberately harmed its customers in order to gain economic benefits over their competitors complying with the regulations on emissions. The Federal Motor Transport Authority (KBA) ordered the recall of several diesel models for illegal check devices.

The VW subsidiary in Stuttgart said that since the autumn of 2017, diesel models in coordination with KBA were carrying out a software update. In Germany, the vast majority of affected vehicles are converted, fully operational and technically safe. Therefore, Porsche AG sees no reason to claim damages. In other regional courts, these had been dismissed so far.

In the VW group, several judgments had already been made in favor of customers wishing to return their diesel cars to different brands. In principle, an appeal against this decision will be formed, said a spokesman for VW. About a dozen lawsuits have now been dismissed by higher regional courts. The first of them would probably be negotiated at the beginning of next year in the Federal Court.
