The Tunisian was expelled from North Rhine-Westphalia to his home country on July 13, although the Gelsenkirchen Administrative Court decided the day before that it was not allowed. Sami A. could threaten to torture there.

However, the decision was not transmitted until the plane with Sami A. was already in the air. The judges denounced the deportation as "grossly illegal" and called on the authorities to bring the man back to Germany.

On the other hand, the city of Bochum, where the Tunisian lived, appealed to the Higher Administrative Court (MVO) of Münster. Last Wednesday, the Gelsenkirchen court announced that it had asked the immigration authorities in Bochum, under the threat of a fine of 10,000 euros, to recover Sami A. next Tuesday.

The Minister of Integration of North Rhine-Westphalia Joachim Stamp (FDP) sees in the upcoming decision of the OVG Münster on the admissibility of expulsion a precedent. "I remain convinced that we have acted legally, we await the decision of the Higher Administrative Court of Münster and will also make the reference for future cases," he told Bild am Sonntag. The decision is expected at the beginning of the week
