New Delhi, May 27 (IANS): The Delhi High Court on Monday urged Robert Vadra, the brother-in-law of Congress President Rahul Gandhi, to file a response to the prosecution's (DE) 's plea to rescind his release on bail. a money laundering case.
Judge Chander Shekhar sent a notice to Vadra and his close badociate, Manoj Arora, listing the case for July 17.
ED insisted that Vadra be questioned in custody, saying that he was not cooperating with the investigation.
On April 1, a court of first instance granted him early release on bail, provided he did not leave the country without authorization and did not join the investigation if necessary.
In his plea before the High Court, the DE challenged the decision of the court of first instance and declared that the protection of Vadra would be detrimental to conducting a free investigation into the case.
The case concerns the possession of 1.9 million pounds of badets abroad by Vadra. This concerns undisclosed foreign badets and entities supposed to evade tax.
The ED told the High Court that Vadra's interrogation was necessary to unearth all the source of credit used for property purchase, transaction determination and money laundering.
"Because it is commonplace to say that early release on bail comes to some extent in the field of criminal investigations and that the courts must exercise caution and circumspection in the exercise of such powers of a discriminatory nature, "said ED in his plea.
"It is for the same reason that the factors relevant for the granting of an advance bond differ significantly from the granting of an ordinary bond … The Special Judge adopted the order under appeal ignoring the elements of the file. "
The investigative agency also said that Vadra's interrogation would help him to determine the role of other key defendants involved in the commission of the offense and their modus operandi.
"Determine the exact source of the contaminated money and the end use of the funds involved," reads the plea and adds: "The confronting (Vadra) with the considerable volume of incriminating documents to conduct the investigation to a logical conclusion ".
The ED pointed out that it was likely that Vadra altered the evidence and influenced the witnesses in the case because he was an influential person.
He stated that although he had several opportunities to explain his alleged role in the case, Vadra remained elusive and was allegedly a victim of political vendetta and that he was not the only one to be involved. he had done everything possible to sensationalise the case.
