The Court of Appeal, sitting in Abuja, on Thursday canceled the election of Ned Nwoko as a senator representing the Senegalese district of North Delta.
In its judgment, the court declared that the case brought before the division of the High Federal Court in Abuja, which had resulted in the recognition of Nwoko as the winner of the elections by the National Independent Electoral Commission (INEC), had been wrongly clbadified.
The court of appeal said that the case should have been brought before the lower court before the expiry of a period of 14 days from the moment the incident caused the pursuit.
In addition, he held that the fact that the applicant had not been tried by the lower court before the expiry of the 14-day period showed that the case was now time-barred and that the lower court He was not competent to deal with the case in the first place.
In his words: "As at the time, the case had been brought before the Federal High Court, the case was time-barred. We annul the decision of the Federal High Court and rulings the case ".
It will be remembered that INEC had withdrawn the certificate of return it had issued to the Nwoko challenger, Senator Peter Nwaoboshi, following the decision of the Federal High Court.
With the verdict of the court of appeal, Senator Nwaoboshi will now be recognized as the elected Senator of the District.
In addition, suffice it to say that MM. Nwoko and Nwaoboshi are both from the PDP and had contested the party ticket during the primaries.
He then won the senatorial elections in the district with Nwaoboshi as candidate.
However, after the first decision of the high court, INEC withdrew the certificate issued to Nwaoboshi and presented it to Nwoko, a decision that is currently invalidated given the current decision of the court of appeal.
