The deputy of Central Bawku, Mahama Ayariga, sued the special prosecutor, Martin Amidu, in case he would be prosecuted for tax evasion and evasion of customs duties.
An application by Ayariga's lawyers to the High Court in Accra requested the Court to strike Martin Amidu's indictment against Ayariga.
The lawyers also want the court to prevent Martin Amidu from pursuing any criminal proceedings against Mahama Ayariga, citing, inter alia, the fact that the special prosecutor was not fit to act as a special prosecutor because of his age.
"I was informed by my counsel that I was convinced that the special prosecutor, Martin Amidu, over 65 years old, was not qualified to hold the post of Special Prosecutor, as this function contravened Article 1991 (11). ) and (4) if the 1992 Constitution of Ghana ", said the Ayariga counter-suit.
His lawyers argue that because of his challenge, Martin Amidu, "does not have the legal capacity to affix his signature on the indictment" and that by Therefore, the indictment signed by him is defective and has no legal effect.
Martin Amidu's lawsuit against Ayariga was initiated about two weeks ago and five charges were laid against the Member of Parliament.
Martin Amidu alleged that Mahama Ayariga had abused the privileges he enjoyed as a deputy by getting a loan for a car but in collusion with a private company to secure funds and import three cheaper vehicles from Dubai. they were for official functions.
Amidu has therefore laid five charges against Ayariga, but Ayariga wants the charges to be dropped and declared "null and void".
The court should sit on the motion on Tuesday, June 4, 2019.
