The Speaker of Parliament, Professor Mike Oquaye, defended Bawku MP Mahama Ayariga, asking the High Court of Accra to respect the parliamentary privilege of the legislator and the immunity, inscribed in the Constitution of 1992.
The Financial and Economic Court of the 2 nd Chamber of the High Court of Accra, presided over by Judge Afia Serwaa Asare Botwe, ordered Tuesday the deputy of Central Bawku, Mr. Mahama Ayariga, to make himself available throughout his trial on certain charges against him. by the special prosecutor's office.
According to the court, she is aware of the immunity granted to lawmakers, including guidelines issued by the Speaker of Parliament, Professor Aaron Mike Oquaye, on how the judiciary treats parliamentarians, but stated that the parliamentarian in question had not been brought before the court as a witness but, as an accused, the certificate issued by the President and the provisions of article 118 (2) were not not applicable and therefore must always appear in court at the trial.
The presiding judge further explained that article 118 (2) of the 1992 Constitution was explicit in this regard. As a result, the Bawku MP could not hide under this law this law relating to the immunity of prosecution.
But in a letter to the Registrar of the High Court, the Financial Court 2, and a copy referred to by Kasapafmonline.com drew the court's attention to various articles of the 1992 constitution, the unfair treatment inflicted on the MP by the court, asking that Mahama Ayariga be treated according to law.
