Manchester City will probably fail in its appeal against a referral to the UEFA FFP Disciplinary Board, as UEFA rules only allow such appeals against "final decisions".
The board of trustees referred to City alleged breaches of the FFP rules earlier this year, but vehemently denied these accusations, calling them "utterly false" in a statement of club.
Nevertheless, they were referred to a Disciplinary Committee after a recommendation from the investigating chamber suggested that the charges had some weight, the Financial Control Body of the clubs having to make a decision in the next few weeks. However, the city has appealed the referral to the Court of Arbitration for Sport, hoping to put an end to the case.

However, a Guardian report explains that these referrals can not be appealed, as the court only allows clubs to appeal the "final decisions" of the BCCB, for which the City has not yet been published.
This means that they will probably have to wait until a verdict is pronounced before an appeal is examined, and if it is found to be contrary to the regulations, it seems very likely that they will do so given the firmness of their position in this regard.
The initial accusations stem from a series of leaks published in the German Der Spiegel outlet, which highlighted a number of potential regulatory breaches, but City soon canceled them in a statement.

"The charge of financial irregularities remains entirely false and the dismissal of the CFCB IC ignores a set of irrefutable evidence provided by Manchester City FC in the House," they said in May.
The club has not yet commented on the latest developments, while UEFA refuses to comment until the case is settled.
