The CAC should have covered the victim of asbestos, according to the High Court

A woman who died of cancer caused by the inhalation of asbestos was entitled to coverage of ACC, ruled the High Court.

Deanna Trevarthen was 45 years old when she died in 2016 from a mesothelioma, caused by exposure to asbestos.

Prior to her death, Ms. Trevarthen asked CCA to cover a wide range of entitlements, such as treatment costs, weekly allowances, a lump sum and funeral expenses.

But his claim was rejected, and ACC stated that, mesothelioma being a condition of the gradual process, it had to be the result of exposure to work to be covered.

Mrs. Trevarthen said her cancer was born from a contact with her father, who was working as an electrician while she was a child.

At the time, this profession was highly exposed to asbestos.

When she was between 4 and 10 years old, she hugged her father when he was wearing his work clothes and she also occasionally played at his work places.

After her death, Ms. Trevarthen's estate continued to badert her rights.

She was tried by the High Court and in a judgment rendered today, Mrs. Trevarthen had the right to cover herself because it was personal injury caused by an accident.
