Mahama Ayariga, a member of Bawku Central's parliament, has asked the High Court in Accra to put an end to a criminal case brought against him by the Special Prosecutor's Office (OSP).
Mahama Ayariga wants the court to suspend the trial proceedings in which he was accused of illegally buying an ambulance for his constituency.
The Member asks the court to stay the proceedings until his appeal to the Court of Appeal challenging the decision of the High Court is no longer resolved, the cases against him are resolved.
Ayariga had asked the High Court to dismiss the charges against him on the grounds that the Special Prosecutor, Martin Amidu, was not eligible to hold the post because of his age, but the court rejected it. .
However, he appealed the decision to the Court of Appeal and wished the High Court to stay the proceedings until it was tried.
At Wednesday's hearing, MP's lawyer, Mr. Godwin Edudzi Tamakloe, urged the court to suspend the proceedings.
According to him, the appeal concerns the heart of the lawsuit because the eligibility of Martin Amidu to the post of special prosecutor could render the trial null and void.
In response, the prosecutor, Micheal Baafi, urged the court to dismiss the claim.
According to him, the MP would suffer no prejudice if the trial was not interrupted but his appeal was successful.
The court, chaired by Judge Afia Serwah Asare-Botwe, is expected to rule on the claim on July 31, 2010.
Context
The OSP indicted the MP and six others, including Bawku's current MCE, Hajia Ninchema, for allegedly engaging in procurement violations.
