Exton Cubic Mines, Manufacturing and Exporting Bauxite
The Supreme Court ruled that the mining leases granted to Exton Cubic, owned by Ibrahim Mahama, were invalid, void and ineffective.
The Court also found that the lease granted to Exton Cubic did not comply with the mandatory legal provisions of the Minerals and Mining Act and Section 268 of the Constitution.
In May 2018, a High Court in Accra ruled that the then Minister of Lands, John Peter Amewu, had no authority to revoke mining licenses granted to Exton Cubic for the purpose of seeking bauxite.
The court quashed the license's revocation by the Minister.
Judge Boafo also ruled that the company had breached several processes during the acquisition of a mining license, a situation that makes it impossible for Exton Cubic to be deemed to have "a mining law as required by law ".
Deputy Attorney General Godfred Yeboah Dame, who felt that the decision was in the government's interest, was quick to add that the judge had exceeded her original jurisdiction.
As a result, he issued a writ before the Supreme Court, urging him to intervene and dismissing the decision of Judge Ackah Boafo.
The five-member jury chaired by Judge Julius Ansah in its unanimous decision and read by Judge Marful Sau stated that when the High Court ruled that the three mining claims had been illegally obtained, it made sense to refuse the claim. of certiorari.
The court therefore ruled that the High Court erred in quashing the letter from the Minister revoking the mining lease.
The Supreme Court declared the three mining leases null and void.
