Latest news: Court grants injunction against elected NDC MP for Assin North

The Cape Coast High Court has granted an injunction against Assin North Constituency-elect James Gyakye Quayson.

The court ruled that James Gyakye Quayson could not run as the elected member of Parliament for the constituency.

This follows a petition filed by one Michael Ankomah that the MP-elect retained his Canadian citizenship when he ran for the polls in December.

According to the petitioner, Mr. Quayson owes allegiance to Ghana and Canada, which contravenes the provisions of Article 94 (2) (a) of the 1992 Constitution of Ghana.

He therefore urged the court to declare his position as elected deputy null and void.

Mr. Quayson, an elected member of the National Democratic Congress (NDC), polled 17,498 while Ms. Abena Durowaa Mensah of the New Patriotic Party (NPP) had 14,793 in the December 7, 2020 election.

But in delivering his ruling on Wednesday January 6, 2021, Presiding Judge Judge Kwasi Boakye said Mr. Quayson was “barred from running as an elected member of the Assin North constituency in the central region of the Republic of Ghana. and further standing for swearing in as a member elected as such until the final decision of the petition.

Meanwhile, the Wenchi High Court chaired by Judge Fredrick Arnold Nawurah overturned a restraining order filed by the National Democratic Congress (NDC) against the inauguration of Mr. Martin Adjei-Mensah Korsah, as a Member of Parliament (MP) of the riding of Techiman Sud. .

The Party filed the injunction asking the court to restrict the nomination of the elected deputy and challenged the validity and result of the results of the parliamentary elections in the constituency.

The petitioners accused the EC of manipulating the compilation of results in favor of the elected Member of Parliament and considered that their candidate, Mr. Christopher Baasongti Bayere, had won the parliamentary seat in the general election which has just ended.

But, during the court session on Tuesday, Judge Nawurah said the petitioners had no cases, saying the document presented by the NDC was inconsistent and without substance.
