Petitioner files motion to compel EC to produce documents

The lawyer for the petitioner in the Election 2020 case has filed a petition for an order requiring the electoral commission to produce for inspection certain documents relating to the 2020 polls.

The alleged documents are the originals of the Constituency Presidential Election Results Collection Forms (Form 9) for all constituencies in Ghana and the originals of the Constituency Presidential Election Results Summary Sheets (Form 10) for all constituencies, including all parties that took part in the December elections. already have in their possession.

The petitioner is also looking for the originals of the compilation of regional presidential election results (forms 11) for all regions, the originals of the regional presidential election results summary sheets (forms 12) for all regions which should also already be in possession parties.

In addition, they are also looking for the original of the Presidential Results Declaration Form (Form 13) and the records of the alleged update of the alleged declaration of presidential election results on December 9, 2020 from four constituencies in the region. of Greater Accra.

Mr. Tsatsu Tsikata is expected to present the petition to the Supreme Court on February 3.

Mr. Tsikata had indicated that acceptance of the request would determine whether or not to call another witness in the case.

The lawyers for the first defendants (CE), Mr. Justine Amenuvor and the second defendants (Nana Addo Dankwa Akufo-Addo) Mr. Akoto Ampaw opposed the petitioner’s request.

Since the petitioner’s petition was filed and served on lawyers today, the Supreme Court chaired by Chief Justice Kwasi Anin Yeboah has ordered the lawyers to file their response to the petitioner’s petition before the end of the day.

The current Election 2020 petition saw the appeal of two witnesses by the petitioner, Mr. John Dramani Mahama.

The two witnesses who have since completed their cross-examination and who were released by the court were Mr. Johnson Asiedu Nketia, general secretary of the NDC and Dr. Michael Kpessa Whyte, party member.

This new motion by the petitioner would delay the testimony of the President of the EC, as she would have stepped on the bench to be cross-examined by the petitioner’s lawyers on Tuesday.

Mr. Mahama is in court to challenge the validity of Nana Addo Dankwa Akufo-Addo’s declaration as the winner of the 2020 election by the Election Commission. He also accuses the EC of voice jamming.
