A founding member of the ruling New Patriotic Party (NPP), Dr Nyaho Nyaho-Tamakloe has warned that there could be a possible uprising in Ghana if citizens lose faith in the country’s justice system.
Commenting on the election commissioner’s decision to evade cross-examination in the ongoing election petition on Morning Starr on Tuesday, Dr Nyaho-Tamakloe called on the Supreme Court not only to base its decision on the law, but also on the mood of the country.
“If we are not careful the people of this country will lose faith in the justice system and that is serious. If we are not careful what happened in Myanmar can happen to him… I am not a judge and I was never a law student but common sense should tell you that you have to judge the mood people.
“Afari Gyan with all his challenges entered the witness stand and testified. What is happening in this country right now is frightening. We know what we have been through and it is like as a nation that we have forgotten where we came from.
The Supreme Court will hear today, February 9, legal arguments from parties involved in the 2020 election petition on whether the President of the Electoral Commission (EC) Jean Mensa will raise the witness stand to testify or not. .
After petitioner John Dramani Mahama closed his case after calling three witnesses, counsel for the EC stated that they intended not to call any more witnesses.
According to Justin Amenuvor, an EC lawyer, the petitioner has not presented any arguments regarding the petition and therefore wishes to waive the right to call any witness, even though Jean Mensa, President of the EC had a witness declaration filed on his behalf.
Akoto Ampaw, counsel for the 2nd Respondent, also indicated that he intended not to call any witnesses despite Peter Mac Manu, who filed a witness statement.
The petitioner’s lead lawyer, Tsatsu Tsikata, said that the President of the EC cannot avoid cross-examination and must raise the witness stand.
The court, after hearing the parties, ordered the parties to make a legal argument on Tuesday for the court to rule on the matter.
