Tesla Inc. is appealing a decision of National Labor Relations Board that he repeatedly violated U.S. labor law, including firing a labor activist, and an agency order directing CEO Elon Musk to delete a threatening tweet from his account.

Electricity-Car manufacturer filed an application Friday with the New Orleans-based United States Court of Appeals to overturn a ruling issued by the regulator on March 25.

“Because the council’s decision and order is against the law, the petitioner respectfully requests the court to allow the petition, review the council’s decision and order, set it aside and grant the petitioner any additional relief that the court considers fair and equitable, ”Tesla said. in his petition.

The decision, made by two Republican members and a Democratic member of the agency, said the company had to offer to reinstate the dismissed employee. Council members also ruled that Tesla broke the law in retaliation against another union activist, “coercively interrogating” union supporters and preventing employees from speaking to reporters.

Tesla denied the wrongdoing and argued that Musk’s tweet was protected by the First Amendment guarantee of free speech.
