An Accra circuit court denied a motion from the management of the Fantasy Dome at the Ghana International Trade Fair Center in Accra, to reopen the facility because other third-party equipment was locked there.
Police locked up the Fantasy Dome when the youth wing of Christ Embassy Church hosted a massive event at the site on Friday, April 30, 2021, where COVID-19 protocols were blatantly violated.
The court, in its decision, said that the plaintiff should have added the Inspector General of Police as a party to the petition.
Meanwhile, the prosecution has not served its witness statement on the accused, although the defense has filed its disclosures.
The court ordered the prosecution to make every effort to file the witness statements they would rely on on or before August 18, 2021.
The case was adjourned until August 27, 2021 for a case management conference.
Previously, Mr. Lord Delvin Essandoh, who held a briefing for Mr. Jerry Avenorgbo, for Mr. Edmond Dapaah, said the facility manager, the instruments and equipment locked in the facility belong to third parties.
The lawyer had previously argued that the facility, which serves as a source of livelihood for A4 and other employees, has been closed to the public since April 30, 2021.
He said it also serves as a recording studio among other business activities. “Currently, there is pressure on the management of the facility from third parties as some of the instruments and equipment have been rented only for the program,” he added.
Mr Essandoh asked the court to order the reopening of the Dome and the release of instruments and equipment in order to restore the livelihoods of the people at the facility. Chief Inspector Simon Apiorsornu, who heads the prosecution, said the state was not opposed to the motion.
The State in the case on the merits has amended the indictment of the four indicted persons, for their involvement in the violation of COVID-19 protocols during the night service of the “Pneumatic Night” organized by the wing youth of Christ Embassy Church.
Defendants Alex Asomani, Wilson Delali Agyemang, Kumi Nutifafa, all members of the Church, have been charged with conspiracy to commit a crime and three counts of failing to comply with restrictions on religious organizations.
Mr. Edmond Dapaah, the director of the installations of the Fantasy Dome at the International Trade Fair Center, was also on the dock accused of aiding and abetting crime. They pleaded not guilty to all counts.
