Mr Quayson in July was removed as an MP after the court ruled in favor of Michael Ankomah-Nimfa, an Assin Bereku resident in the central region who filed a petition with the Cape Coast High Court aimed at canceling the 2020 legislative elections in the constituency. .
The petitioner in his case said that by the time the MP applied for the 2020 parliamentary elections, he had not renounced his Canadian citizenship and therefore had dual citizenship.
Earlier this week after the ruling, James Gyakye Quayson appealed arguing that the Cape Coast High Court erred in its ruling.
Today, he filed a suspension of the executive motion to suspend the execution of the order of the High Court which seeks to revoke him as an elected member of Parliament.
According to him, the stay of execution is necessary because even if the Court decides to proceed with a by-election and his appeal case is not settled, he can obtain an injunction to stop the election.
“That, if the High Court’s decision is not stayed, it could give rise to considerable political tension in the constituency of Assin North and possible disruption of the peace.
“That if the decision of the High Court is not stayed and my appeal is successful, as counsel advises and it is true, it is inevitable, the decision of this Court of Appeal on my appeal would be made obsolete simply by the passage of time.
“That failure to stay the execution of the judgment would not only cause injustice and irreparable damage to the residents of Assin North constituency and myself, but would also lead the 2nd defendant to spend significant financial resources to organize a by-election. when the errors of the High Court mean that it is not justified to hold such a by-election, ”further argues the application for a stay of execution filed by James Gyakye Quayson.
