Walter Magaya, head of the Prophecies of Healing and Delivering (PHD) ministries, was convicted for violating certain provisions of the Control of Drugs and Allied Substances Act by manufacturing and marketing an anti-cancer drug. HIV without prior authorization from the authorities.
He broke the law by announcing last November that he had finally found a cure for HIV / AIDS in the form of a herbal medicine called Aguma.
Appearing before Harare magistrate Rumbidzai Mugwagwa on behalf of his company, Aretha Medicines, Tuesday morning, Magaya was found guilty of pleading guilty.
Through his lawyer, Everson Chatambudza, Magaya was quick to point out that his only problem was the premature announcement that he had found the treatment, but that his drug was perfect.
"The drug has been subjected to laboratory testing in India and the discovery has been proven before the announcement.
"It is only a technical fact for which the accused ignored only the procedures defined by advertising the drug without complying with the law. word "discovery" is still valid, "said his lawyer.
Magaya pleaded for leniency claiming that he had tried to follow the procedure, but that officials from the country's health ministry had badly received him.
"The court must consider that prior to his arrest, the accused had apologized to the world on November 1, 2018 …," said Chatambudza.
"The accused tried to comply with the law.
"Three days before the announcement, he wrote to the department to inform him of the discovery and his intention to announce his discovery to the world, clear evidence that he was seeking advice.
"Unfortunately, he received no response.
"If the Ministry reacted by setting guidelines, the accused should have complied with them."
Magaya was to be sentenced Tuesday afternoon.
