The High Court of Accra dismissed the Attorney General's request to seek an end to the bail given to Gregory Afoko, one of the men accused of killing Alhaji Adams Mahama, president of the region of Haut Patriot) in 2015.

In a decision dismissing A-G's stay today, the court, presided over by Judge George Buadi, found A-G's claim unsubstantiated.

According to the court, the A-G did not argue any exceptional circumstances to convince the court to stop bail.

The court further found that most of the arguments invoked by the A-G were already contained in the A-G's response to the bail application, which had initially been rejected by the court.

On March 14, 2019, the court admitted Afoko to pay a deposit of 500,000 Gh with two bonds, one of which had to be justified.

The court also ordered Afoko to report every two weeks to the headquarters of the Criminal Investigation Department (CID) of the Ghana Police.

Unsatisfied, the Applicant appealed to the Court of Appeal and also sought a stay of execution in the High Court pending the final decision on the appeal.

In pleading for the application Friday, Mrs. Mariana Appiah Opare, a Attorney General, urged the court to end the bail, as it was likely that the appeal would succeed.

She argued that if the stay of execution was refused, the appeal would be insignificant if it ended up before the Court of Appeal.

In response, Afoko's lawyer, Mr. Stephen Sowah Charway, described the petition as incompetent, unfounded and an affront to the country's judicial system and requested that it be rejected.
