The government warned all players in the SIM card registration value chain, including subscribers and agents of mobile phone network operators, to ensure compliance with the registration process and activation of the SIM card, in accordance with the legal provisions in force.
The Minister of Information, Kojo Oppong Nkrumah, at a press conference in Accra, revealed that the government, through the Ministry of Communications, had noted with concern the many deficiencies of the existing SIM card registration system in Ghana.
Mr Nkrumah stated that the concerns concerned the sale of prerecorded SIM cards, the use of prerecorded SIM cards and the use of fraudulently registered SIM cards.
"These deficiencies give way to fraudulent activities to perpetuate via the use of mobile phones such as mobile money fraud, the illegal exchange of SIM cards, the termination of international traffic (SIM-Boxing) resulting in a loss of revenue for the state, imprisonment and cybercrime. Given that the government is committed to migrating to a digital economy formalized under Ghana's Digital Development Program (DGA), it is important for the communications industry to ensure the integrity of a database and integrated systems. It will also enhance security and confidence in the use of digital services, "he said.
The Minister said that while badociating with the relevant institutions for the full deployment of national identity cards for the registration of SIM card, the National Communications Authority (NCA) ) will ensure strict compliance with the law and encourage mobile network operators and all relevant stakeholders to address these shortcomings.
STATUTORY PROVISIONS
The Minister stated that all stakeholders must comply with the relevant statutory provisions listed below:
• Subscriber Identification Module Registration Regulations, 2011 (L.I. 2006), which governs the responsibilities related to the registration of the SIM,
• Section 73 (a) of the amended Electronic Communications Act. 2016 (Law 910) which states that:
"(1) A network operator or service provider must comply with guidelines established by the Authority to: (a) prevent; (b) detect; or (c) disconnect the use of the subscriber identity module or the user identity module of that operator to terminate an international call on any network at Ghana as a local call.
(2) A person who uses a subscriber identity module or a user identity module to terminate an international call on any network in Ghana as a subscriber. local appeal is guilty of an offense and liable on summary conviction to a fine of not more than three thousand penalty units for each subscriber identity module or identity module; User used to terminate the international call as a local call or for a maximum term of imprisonment of five years, or both. "
• Article 73 (b) of the law amending the law on electronic communications. 2016 (Law 910) which also states that:
"(1) A person must not use a pre-registered subscriber identity module or a user identity module.
(2) Every person who knowingly exploits a prerecorded subscriber identity module or a user identification module is guilty of an offense and liable on summary conviction to a fine not exceeding three thousand penalty units or to imprisonment for a maximum of of: five years or both.
(3) For the purposes of this section, "pre-registered subscriber identification module or user identity module" means a module that has been registered with the data from someone other than the one who eventually acquired the module for use on a network. unless the law allows it. "
Nkrumah said the government is committed to building a strong, secure and resilient communications sector for the benefit of citizens and the country as a whole.
"So we encourage all subscribers to check the authenticity of their SIM registration by dialing * 400 # on any network," he said.
