Judge DK Jain, the BCCI Ombudsman, sent notices to both Hardik Pandya and KL Rahul, asking them to be present during the controversy surrounding their remarks during a televised debate at Indian television. The hearings will be held in Mumbai. Pandya's hearings will be scheduled on April 9 and those of Rahul the next day.
This is the first question on which Judge Jain, appointed by the Supreme Court in February, will rule.
Judge Jain told ESPNcricinfo that, as part of the natural justice process, he had to hear both players before deciding on the case.
Asked that the players had confirmed their presence, Judge Jain replied that it was not necessary, but that it was important that he listened to what they had to say. . "I sent them the notice, it's up to them to appear or not," he said. "It's part of natural justice.You can not hold anyone guilty without giving him the opportunity to present his case."
The hearing schedule is of concern to IPL franchisees of both players – Mumbai Indians (Pandya) and Kings XI Punjab (Rahul). Incidentally, Mumbai will host Kings XI during an evening game on April 10. It remains to be seen if Rahul will be on the bill.
Judge Jain stated that BCCI did not give him time to make a final decision. However, the management of the Indian team as well as the national coaches would like clarity keeping in mind the World Cup, the team for which the team will be selected around April 25, the tournament starting May 30 .
The BCCI Board of Directors suspended proceedings against Pandya and Rahul in January following their offensive remarks on the Koffee with Karan TV show aired on January 9th. The two players, who were in Australia to return home and suspended two days later. Subsequently, on 24 January, the suspension was provisionally lifted pending an investigation.
