A former state pathologist sentenced to 10 years in prison for stealing parts of the body

The former medical examiner specialized in Diepkloof has been sentenced to 10 years in prison for the theft of human organs in corpses, the national prosecuting authority said Friday.

Dr. James Blair Mwesigwa, 60, was sentenced Friday in Kempton Park Regional Court.

The state has managed to prove that he raped Alida Scheepers' body after summoning him for a post-mortem examination, said Gauteng NPA spokeswoman Phindi Mjonondwane.

"The lawyer, Riana Williams, was able to present convincing evidence that the court removed Mwesiga without permission from the family and notably withheld the heart, lungs, pharynx and larynx of Scheepers' body. "

The Daily Sun reported that Mwesigwa was suspended from the Diepkloof morgue in November 2013 after attempting to leave the morgue with a bucket containing a brain and a heart.

The doctor did not record or indicate the reasons for which he had proceeded according to the requirements of the Law on the Use of Human Biological Materials in the National Health Law 61 of 2003.

Mwesigwa's thesis was found to be insubstantial and non-binding for him to be sentenced to a lessor's term. He had previously lodged an application for leave to appeal to the High Court against the conviction and sentence, which had been dismissed.
