CONCORD, NH (AP) – An itinerant hospital technician sentenced to 39 years in prison for having infected hepatitis C patients in several states with the help of soiled syringes has asked a federal judge for the treatment of hepatitis C. cancel his sentence, claiming that his lawyer was ineffective.
David Kwiatkowski (Kwiht-KOW-skee) was sentenced in 2013 after confessing he stole pain syringes from the hospitals where he worked and replaced them with syringes filled with blood-stained saline. He was at Exeter Hospital in New Hampshire when he was arrested.
Kwiatkowski, 39, filed in prison in Sumterville, Florida. He must be released in 2046.
He wrote that his lawyer had allowed him to plead guilty in a state of extreme emotional distress and that his sentence had been miscalculated.
A spokeswoman for the US prosecutor's office declined to comment.
