The defense attorney in the case involving Gregory Afoko, accused of murdering former regional president of the New Patriotic Party (NPP) of the Upper East Side, filed the case after a series of charges. Adjournments of the court to allow them to call their witnesses.
The defense being represented in court, Ms. Benedicta Antwi said Thursday in court that their witness was still not available and that she would therefore like to close their case.
She said, "After reviewing our files, we think we can close our file."

In his response, the prosecution told Mr. Mathew Amponsah that they had no objection to that.
The court presided over by Justice Lawrence L. Mensah stated that the court had a constitutional obligation to give the defense time to defend itself, which the court rightly did.
The court ordered the defense to file its closing speech by 8 February at the latest and to continue to respond with a closing statement no later than 19 February.
The case has since been postponed until February 20 for the defense to go to court and February 21 for the prosecution to do the same. A date for the summary would be announced later.
At the previous sitting, the defense lawyer had asked the court to give a second chance to the presentation of his second and probably last witness, otherwise he would file the case.
The prosecution summoned 14 witnesses and the defense appealed one.

Afoko, a farmer, reportedly killed Mr. Mahama on May 20, 2015 and is currently charged with conspiracy to commit murder and murder.
He pleaded not guilty in court, consisting of a seven-member jury.
