President Akufo-Addo has initiated processes to determine whether Chief Justice Kwasi Anin-Yeboah should be removed from office. This follows a petition from the lobby group Alliance for Social Equity and Public Accountability (ASEPA) demanding the removal of the chief justice.
The Chief Justice (CJ) has made headlines in recent weeks following allegations by private lawyer Akwasi Afrifa that he demanded a $ 5 million bribe to return a favorable judgment in a case involving his client.
Judge Anin-Yeboah has since denied the allegations and asked the police CID to investigate the case.
ASEPA argues that the Chief Justice is unfit to perform his duties and wants him removed.
Under Article 146 (6) of the Constitution of Ghana, the President, upon receipt of such a request, must act in consultation with the Council of State to appoint a committee consisting of two judges of the Supreme Court and three other persons who are not members of the Board. state, deputies, or lawyers to investigate the petition and make a recommendation.
A letter written to the Executive Director of ASEPA by President Secretary Nana Bediatuo Asante indicates that the President has initiated the appropriate processes.
Under the constitutional procedure, the work of the committee takes place behind closed doors, the President of the Republic having the possibility of defending himself or through a lawyer or any expert of his choice.
The President reserves the right to suspend the President of the Supreme Court even before the end of the investigation on the advice of the Council of State.
