Amaliba New Olk Abraham Amaliba, Private Lawyer

The special prosecutor, Martin Amidu, is determined to pursue Bawku's central legislator Mahama Ayariga at all costs, said Abraham Amaliba, a private lawyer and member of the National Democratic Congress (NDC).

Mr. Amidu recently obtained a court order obliging the MTN mobile phone company to disclose to the Office of the Special Prosecutor conversations between Mr. Ayariga and an official of the Ghana Revenue Authority (GRA) in connection with investigations into the operations of the legislator.

The court made the order on January 22, 2019 at the request of Mr. Amidu.

Mr. Amidu told the court presided over by Ms. Ruby Naa Adjeley-Quayson that the Special Prosecutor's Office (OSP) had already been ordered to conduct a forensic examination on three mobile phone numbers of the Director General the Criminal Investigation Department) of Ghana Police.

He urged the court to exercise the powers conferred upon it by the 2008 Electronic Transactions Act (Law No. 772) of Articles 100, 101 and 103.

Amidu, known for his fierce stance against corruption, recently suggested that prosecutions would be filed against corruption cases this year.

Speaking at the Citizen Show on Accra 100.5 FM hosted by Kwabena Bobie Ansah on Thursday, January 24, 2019, Mr. Amaliba said: "The Special Prosecutor is using Mahama to pursue Ayariga's and has to court to require communications between the officials of Ayariga and GRA.

"This type of request should have been made with notice. People have the right to privacy, the Constitution stipulates that these rights must be protected.

"Although the state has the right to intervene, the rule of natural justice requires that you give the person notice that you want the court to help you obtain certain communications between him and another person. . "

He added: "I am aware that this decision will be challenged in court."
