An NDC official's attempt to end his criminal trial is dismissed

A high court in Accra has rejected a petition filed by NDC deputy communications director Kwaku Boahen to strike a charge of conspiracy to harm his person.

Judge Samuel Asiedu found that the petition was unfounded because it invited the court to badess the case even before attorneys general called their witnesses to prove their charges.

The NDC's national president, Samuel Ofosu Ampofo, and Mr. Boahen are currently being tried for the leak of public prosecutors. The leader of the NDC allegedly committed a conspiracy to commit various crimes.

Kwaku Boahen's lead counsel, Dr. Aziz Bamba, who moved the application, argued that the documents filed by the AG did not fulfill the necessary elements to support a charge of conspiracy to cause injury.

Attorney General Asiamah Sampong opposed this request. He argued that it was premature because state attorneys wanted during the trial to prove the case with credible evidence.

He added that the court had already ruled on a similar petition filed by Lawyers for the NDC president.

Judge Asiedu rejected the request, ordering prosecutors to call their first witness to testify.

Mr Ampofo's lead counsel, Tony Lithur, informed the court that a request for a stay of proceedings had been filed.

Judge Asiedu said that he was not aware of the request and asked that the case continue.

Attorney General Asiamah Sampong, however, informed the court that the first state witness was not available.
