ASEPA invokes section 146 to remove chief justice

The Alliance for Social Equity and Public Accountability (ASEPA) has, through a petition to President Akufo-Addo, invoked the provisions of Article 146 to initiate impeachment proceedings against the Chief Justice Kwasi Anin-Yeboah for the $ 5 million corruption allegation.

Chief Justice made headlines for the wrong reason following an allegation by lawyer Akwasi Afrifa Esq that he demanded a $ 5 million bribe from his client, Nana Ogyeedom Obranu Kwesi Atta VI to help him win a case he had before the Supreme Court. .

Although Judge Kwasi Anin-Yeboah later denied the allegations and referred the case to the Criminal Investigation Department (CID) of the Ghanaian Police Service for investigations, ASEPA wants more to be done.

In a petition to President Akufo-Addo on Tuesday, July 13, 2021, the advocacy group called for the chief justice to be impeached in accordance with the provisions of Article 146.

“In accordance with article 146, the president, upon receipt of our request, in consultation with the Council of State must refer the request to a committee set up to investigate the allegations, the president must also ask the chief judge to step aside so that the committee can finish their work, ”reads the ASEPA petition signed by Executive Director Mensah Thompson.

He adds: “We believe the CID can work with the committee that will be formed by the president to investigate the allegations.”

Meanwhile, calls for the presiding judge to step down to investigate the corruption allegation have the backing of the National Democratic Congress (NDC).

At a press conference earlier today, Secretary-General Johnson Asiedu Nketia said: “Best practice would require the Chief Justice to step down temporarily until the issues are considered and a clear outcome emerges and we think that this instance calls for such action “.
