Lawyers for Assin North Constituency MP James Gyakye Quayson have filed a motion in Cape Coast High Court to prevent the court from moving forward to render judgment on Wednesday, July 14, 2021.
They also want to prevent the court from hearing the dual nationality case and have therefore filed a petition with the Supreme Court to invoke the supervisory jurisdiction of the Supreme Court to assume jurisdiction of the case in the Cape Coast High Court. .
The petitioner, Michael Ankomah Nimfah, argued that Mr Quayson had dual Ghanaian and Canadian nationality at the time of his election and should therefore be barred from serving as an MP.
The Cape Coast High Court Three set Wednesday July 14, 2021 to deliver judgment in the Assin North dual nationality case, but again adjourned the case to July 28, 2021, pending the hearing of the petition filed with the Supreme Court on July 27, 2021.
National Democratic Congress (NDC) national president Samuel Ofosu Ampofo said the party is very uncomfortable with the date of the judgment.
He believes there is evidence to justify that the member for Assin North was duly and correctly elected.
Samuel Ofosu Ampofo argued that James Quayson was duly elected and would ultimately be exonerated.
“In the actual verification process, we followed a process where our legal team reviewed the documents of everyone who had resided outside the country… and we were satisfied. ”
The Election Commission also ruled on this case and exonerated him before he submitted his candidacy.
“This attempt to use technical details and for the judge to skip due process and go ahead with judgment is something we are not prepared to accept.”
One of the claimant’s lawyers, Henry Nana Boakye, in an interview called the claim filed by NDC lawyers inconceivable and incompetent.
He said the claim was unfounded in law.
