The government warned players in the SIM card registration value chain, including subscribers and agents of mobile phone network operators, to ensure compliance with the registration process and activation of the SIM card, in accordance with the legal provisions in force.
The government, through the Ministry of Communications, has expressed concern over a number of shortcomings in the current SIM card registration regime in the country.
They understand:
1. The sale of pre-registered SIM cards,
2. The use of pre-recorded SIM cards and
3. The use of fraudulently registered SIM cards.
According to Minister of Information, Kojo Oppong Nkrumah, these shortcomings are giving way to fraudulent activities that are perpetuated by means of mobile phones, such as:
1. mobile money fraud
2. Illegal SIM card exchange
3. Cessation of international traffic (SIM-Boxing) resulting in loss of revenue for the State
4. usurpation of identity
5. Cybercrime
At a press conference in Accra on Sunday, March 31, 2019, Mr. Nkrumah said that as part of the government's commitment to migrate to a digital economy formalized as part of Digital Ghana's strategy (DGA), it is important that the communications industry ensures the integrity. database and integrated systems. "This will also enhance security and confidence for the use of digital services."
He said: "While we are working with relevant institutions for the full roll-out of national identity cards for SIM registration, the National Communications Authority (NCA) will ensure strict adherence to the law and will engage mobile network operators and all relevant stakeholders to address these shortcomings "
According to Mr. Nkrumah, all actors must respect the relevant legal provisions listed below:
• Subscriber Identification Module Registration Regulations, 2011 (L.I. 2006), which governs the responsibilities related to the registration of the SIM,
• Section 73 (a) of the amended Electronic Communications Act. 2016 (Law 910) which states that:
"(1) A network operator or service provider must comply with guidelines established by the Authority to: (a) prevent; (b) detect; or (c) disconnect the use of the subscriber identity module or the user identity module of that operator to terminate an international call on any network at Ghana as a local call.
(2) A person who uses a subscriber identity module or a user identity module to terminate an international call on any network in Ghana as a subscriber. local appeal is guilty of an offense and liable on summary conviction to a fine of not more than three thousand penalty units for each subscriber identity module or identity module; User used to terminate the international call as a local call or for a maximum term of imprisonment of five years, or both. "
• Article 73 (b) of the law amending the law on electronic communications. 2016 (Law 910) which also states that:
"(1) A person must not use a pre-registered subscriber identity module or a user identity module.
(2) Every person who knowingly exploits a prerecorded subscriber identity module or a user identification module is guilty of an offense and liable on summary conviction to a fine not exceeding three thousand penalty units or to imprisonment for a maximum of of: five years or both.
(3) For the purposes of this section, "pre-registered subscriber identification module or user identity module" means a module that has been registered with the data from someone other than the one who eventually acquired the module for use on a network. unless the law allows it. "
The government badured the public that it was committed to building a strong, secure and resilient communications sector in the interest of citizens and the country as a whole.
