A high court in Accra dismissed a case brought by former member of the Ghana National Gas Company's board of directors, Ms. Valerie Sawyerr, to overturn the adverse findings that the Bureau of the Economic and Organized Crime (EOCO) had taken against it.
In October 2018, Ms. Sawyer sued the Attorney General and the Office of Economic and Organized Crime (EOCO), after a forensic audit accused her team at the Ghana Gas Company of certain financial irregularities.
The report authorized by a cabinet committee responsible for coordinating investigations revealed that helicopters purchased from the China Aviation and Import Export Corporation were never used for the purposes for which they were used. had been bought.
He further revealed that helicopter equipment was never delivered even though it was part of the original contract price, including initial training costs that were not used for the intended purpose.
Court counsel, Dr. Sawyer, argued that the fact that the auditors did not contact their client prior to the release of the audit report constituted a violation of his right to a fair hearing.
MP A-G, Godfred Yeboah Dame, in her response to the writ, described the application as "manifestly incompetent".
He baderted that the auditors were under no obligation to contact her, their work being neither judicial nor quasi-judicial.
In its judgment, however, the court found that the audit report prepared by Morrison & Associates was part of the investigation process and was submitted to EOCO so that it could continue its work. investigations.
The court explained that EOCO had to give him a hearing.
The decision further pointed out that EOCO had actually granted her this hearing, which was confirmed by an invitation letter which she had attached to her application.
She had thus had the opportunity to be heard and her natural justice had not been violated, the court said.
